CollisionIQ Privacy Policy

CollisionIQ™ LLC ("CollisionIQ," "we," "us," or "our") is committed to protecting the privacy of the collision repair facilities ("Shops") that use our platform and the end customers whose data Shops process through our Service. This Privacy Policy explains how we collect, use, store, and protect information in connection with the CollisionIQ™ platform.

1. Information We Collect

1.2 End Customer Data Processed on Behalf of Shops

When Shops use CollisionIQ™ to manage customer communications, we process the following categories of end customer data on the Shop's behalf:

1.2A Sensitive Personal Information

Some data processed through the Service may constitute sensitive personal information under applicable state privacy laws, including insurance information and financial data such as deductible amounts. CollisionIQ™ processes this information solely for the purpose of enabling accurate and personalized customer communications through the Service and does not use sensitive personal information for advertising, profiling, or secondary purposes. CollisionIQ™ does not sell sensitive personal information.

1.3 Automatically Collected Information

1A. Cookies and Tracking Technologies

CollisionIQ™ uses cookies and similar tracking technologies on the collisioniq.app website to operate the Service, maintain login sessions, and analyze usage patterns. Specifically:

CollisionIQ™ does not use advertising cookies or sell tracking data to third parties. By using the Service, you consent to CollisionIQ™'s use of cookies as described in this section.

2. How We Use Information

We use the information described above for the following purposes:

2A. Artificial Intelligence Disclosure

CollisionIQ™ uses artificial intelligence to generate message drafts, call scripts, escalation assessments, communication health scores, and vehicle closeout summaries. The following data is sent to Anthropic PBC's API for AI processing: customer first name, vehicle information, insurance carrier name, repair stage, estimated completion date, deductible amount where entered, communication thread content, shop knowledge base content, and voicemail transcription content. Full customer names, phone numbers, home addresses, and payment information are not sent to Anthropic's API.

Under Anthropic's current API terms, Anthropic does not use API inputs to train its models without explicit consent. CollisionIQ™ does not sell data to Anthropic or any AI provider. AI-generated content is produced by automated systems and may not always be accurate. All AI-generated messages are subject to advisor review before sending unless automated sending has been enabled by the Shop.

CollisionIQ™ recommends that Shops disclose to their customers that communications may be generated or assisted by artificial intelligence. Suggested customer-facing disclosure language: "[SHOP NAME] uses a communication management platform that may use artificial intelligence to assist with text messages about your vehicle repair. All communications are reviewed by our staff. Contact us directly at [SHOP PHONE] with any questions."

3. Voice Recording and Transcription Data

When voice features are enabled by a Shop, we may collect and process:

3.1 Retention of Voice Data

3A. SMS Messaging and Mobile Communications

CollisionIQ™ sends automated SMS text messages to vehicle repair customers on behalf of collision repair shops using the Service. This section describes how mobile phone numbers are collected, used, and protected.

3A.1 Consent and Opt-In

Customer mobile phone numbers are collected at the time of vehicle check-in by the service advisor. Before any message is sent, the service advisor must confirm that the customer has provided express written consent to receive automated text messages by checking a mandatory consent checkbox in the CollisionIQ check-in form. The checkbox is unchecked by default and the form cannot be submitted without active confirmation. The consent timestamp is recorded automatically at the time of submission.

The consent disclosure presented at check-in reads: "By checking this box, I agree to receive text messages regarding vehicle repair updates, repair status notifications, scheduling information, and customer service communications. Message frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for assistance. Consent is not a condition of purchase."

3A.2 Message Types and Frequency

Customers who have provided consent may receive the following types of SMS messages: vehicle check-in confirmation, repair stage updates, scheduled status updates (typically sent Monday, Wednesday, and Friday), pickup notification, post-delivery follow-up, and satisfaction check-in. Message frequency varies depending on the repair timeline and vehicle status. Customers typically receive between 3 and 12 messages per repair.

3A.3 Message and Data Rates

Message and data rates may apply depending on the customer's mobile carrier and plan. CollisionIQ™ does not charge customers for SMS messages. Standard carrier rates for text messaging and data usage may apply.

3A.4 Opt-Out

Customers may opt out of receiving SMS messages at any time by replying STOP to any message. Upon receiving a STOP reply, all automated messages to that customer will cease immediately. Customers may reply HELP for assistance or contact the repair shop directly to request removal from SMS communications.

3A.5 Mobile Number Privacy

Customer mobile phone numbers collected through the Service are used solely for the purpose of sending vehicle repair status updates on behalf of the collision repair shop. Mobile phone numbers are not shared with third parties or affiliates for marketing or promotional purposes. Mobile phone numbers are not sold. Mobile phone numbers are not transferred to any party for use in any campaign other than the vehicle repair communications described in this section.

4. Information Sharing and Disclosure

We do not sell your data or your customers' data. We share information only in the following circumstances:

We share data with third-party service providers who assist us in operating the Service, including:

All service providers are contractually required to process data only as directed by CollisionIQ™ and to maintain appropriate security standards.

4.1A Data Sent to Anthropic PBC

CollisionIQ™ uses Anthropic PBC's AI language model API to generate message drafts, call scripts, escalation assessments, health score analysis, and vehicle closeout summaries. To generate this content, CollisionIQ™ sends the following categories of data to Anthropic's API:

CollisionIQ™ does not send full customer names, phone numbers, home addresses, Social Security numbers, or payment card information to Anthropic's API. CollisionIQ™ uses Anthropic's API in a manner consistent with Anthropic's usage policies. Under Anthropic's current API terms, Anthropic does not use API inputs to train its models without explicit consent. Shops should be aware that communication content is transmitted to Anthropic's systems for processing and should factor this into their own customer disclosure obligations.

4.2 Legal Requirements

We may disclose information when required by law, court order, or governmental authority, or when we believe disclosure is necessary to protect the rights, property, or safety of CollisionIQ™, our customers, or others.

4.3 Business Transfers

In the event of a merger, acquisition, or sale of substantially all of our assets, customer data may be transferred to the acquiring entity, subject to the same privacy protections described in this Policy.

4.4 Payment Processor

Payment processing is provided by Stripe Inc. When you provide payment information, it is transmitted directly to Stripe and processed according to Stripe's Privacy Policy available at https://stripe.com. CollisionIQ™ does not store full payment card numbers, CVV codes, or other sensitive payment credentials on its servers. CollisionIQ™ receives only limited payment confirmation data from Stripe including last four digits, card type, and billing address for verification purposes.

5. California Privacy Rights (CCPA and CPRA)

If you are a California resident or if your customers are California residents, additional rights and obligations apply under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

5.1 Categories of Personal Information Collected

We collect the categories of personal information described in Section 1 above, which may include identifiers, commercial information, electronic communications, and professional information.

5A. Texas and Other State Privacy Rights

In addition to California, residents of the following states have privacy rights that may apply to personal data processed in connection with the Service:

6. Data Security

We implement commercially reasonable administrative, technical, and physical security measures designed to protect your information from unauthorized access, disclosure, alteration, or destruction. These measures include:

No security system is impenetrable. We cannot guarantee the absolute security of your information. In the event of a breach affecting your data, we will notify you as required by applicable law.

7. Data Retention

We retain Shop account data and vehicle records for the duration of your subscription plus thirty (30) days following termination, during which time you may request a data export. After this period, your data is permanently deleted.

End customer communication records are retained for the duration of your subscription. Upon subscription termination, end customer data is deleted on the same schedule as Shop account data.

We may retain certain data for longer periods as required by applicable law or for legitimate business purposes such as tax compliance and legal defense.

8. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe we have inadvertently collected information from a minor, please contact us immediately at john@collisioniq.app.

9. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify Shops of material changes by email or through the Service at least thirty (30) days before the changes take effect. Continued use of the Service after the effective date of updated terms constitutes acceptance of the revised Policy.
